The Notary Office serves both Polish citizens and foreign nationals. The notaries and the office staff speak various foreign languages, all of them speak English.

In the Polish legal system, a notary is a lawyer who has passed the state notarial examination after completing a 3,5-year notarial apprenticeship and a 5-year uniform Master’s degree in law, subject to the exceptions specified in the Notarial Act cited above.

In the Polish legal system, a notary does not represent any party to a legal transaction in the traditional sense, as an attorney or legal adviser would. Instead, the notary’s role is to safeguard the interests of all parties, explain the legal consequences of the transaction, and formally confirm their intentions in an official document.

A notary is appointed by the Minister of Justice to perform acts that the parties are required to carry out, that is, when the law mandates the notarial form due to the importance of the act (these are mainly transactions involving real estate and inheritance matters), or when the parties wish to give their act a notarial form even though the participation of a notary is not legally required, but they nevertheless choose to use the notary’s assistance as a guarantee that the act will be carried out correctly. Notarial acts performed by a notary in accordance with the law constitute official documents.

Within the scope of their authority, a notary acts as a person of public trust and is afforded the protection granted to public officials.

The Polish notariat has a centuries-old tradition and belongs to the group of Latin-type notariats, also referred to as the classical model. Alongside the Latin-type notariat, there are notarial systems operating within the legal order known as common law, characteristic of Anglo-Saxon countries such as the United Kingdom, the United States, Australia, New Zealand, and Canada (excluding Quebec), Ireland (excluding Gaeltacht), and South Africa (excluding Volkstaat). All of these countries were once British colonies and—except for the United States and Ireland—are currently members of the Commonwealth of Nations. These are fundamentally different legal systems, in which the role of a notary, their responsibilities, and their professional training differ significantly. In the common law system, the role of a notary, known as a notary public, is limited compared with the Latin model. Liability for damages also differs, as documents prepared by a notary public do not have the status of official documents, unlike in the Polish legal system.

Notaries in common law countries do not perform acts such as drawing up notarial deeds with the same legal effects as in Poland. Their tasks consist mainly of certifying identity, certifying copies of documents as true to the original, and administering oaths.

The earliest references to notaries in the Polish lands date back to the Middle Ages. The activity of notaries was connected to the structures of the Church, and the first known notarial document in Poland comes from the 13th century; it was drawn up by a notary appointed by the Archbishop of Gniezno, Jakub II Świnka. The notarial profession evolved over time, and the status and institutional position of notaries largely depended on the historical period, which is why terms such as “rejent” or “judge” are still used today in reference to this profession.

The Notary Office is located on the first floor of a modern building at 12B Postępu Street, unit 45, in Warsaw—within the business district of Mokotów, in the Służewiec area—close to the Galeria Mokotów shopping center (Westfield Mokotów), approximately 300 meters in a straight line. It is also near the Wilanowska metro station (about 2 km) and Warsaw Chopin Airport (Okęcie) (approximately 4.3 km).

The office has been operated by the same notaries for over 12 years, which is a testament to its stability. For four years, the office was located on the ground floor of the building at 7A Obrzeżna Street, unit U1, and then for five years in the New City office building at 12 Postępu Street. Due to dynamic growth, it is currently located in the building at 12B Postępu Street.

A notary possesses officially granted powers, which guarantees that acts performed before a notary comply with the applicable laws.

The office is open Monday to Friday from 9:00 AM to 5:30 PM, with the exception that on Wednesdays the office hours are extended until 7:00 PM.

It is also possible to schedule a notarial appointment outside regular office hours, including on Saturdays and Sundays, by arranging it in advance by phone.

Notarial acts are performed in accordance with applicable legal regulations in Polish, which is the official language.
